Terms of Service

Welcome to CapeQuest. These Terms of Service ("Terms") are an agreement between you (the parent or legal guardian) and CapeQuest ("we", "us"). By ticking the agreement boxes at signup and onboarding, or by using the app, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you don't agree, please don't use CapeQuest.

1. Who can use CapeQuest

  • Accounts may only be created by a parent or legal guardian aged 18 or older.
  • The app is designed for children roughly 7–12 years old, used with parental supervision.
  • You confirm you have the legal authority to consent to your child's use of the app.

2. Your account & PIN

You are responsible for your login credentials and the 4-digit Parent HQ PIN. Keep them private. Any activity under your account is your responsibility. If you suspect unauthorized access, change your password and email us right away.

3. Subscriptions & billing

  • CapeQuest offers a Free plan (with limits, such as 1 hero and up to 6 active missions) and paid plans that unlock more heroes, missions, First/Then, Power-Up anchors, and other features.
  • Paid subscriptions are billed in advance on a recurring basis (monthly or annual) through our payment processor (PayMongo). Prices are shown in-app before checkout.
  • Your subscription renews automatically until you cancel. You can cancel any time from Parent HQ → Settings; cancellation stops the next renewal but does not shorten the current paid period.
  • You are responsible for keeping your payment method up to date. If a charge fails, we may downgrade your plan to Free until payment succeeds.

4. Refunds

If something goes wrong or you were charged in error, email hello@capequest.app within 14 days of the charge and we'll review it in good faith. Refunds are handled case-by-case and processed through PayMongo. We don't automatically refund partial months after a cancellation.

5. Free trials & promotions

We may offer free trials or promotional pricing. If a trial converts to a paid subscription, we'll tell you before it does. Promo terms (duration, eligibility) are shown at the time of offer and take precedence over general pricing.

6. Acceptable use

You agree not to:

  • Share your account with people outside your household.
  • Reverse-engineer, scrape, or attempt to break the app or its infrastructure.
  • Upload content that is unlawful, harmful, hateful, sexual, or otherwise inappropriate for children.
  • Use CapeQuest to harass a child or bypass a parent's controls.
  • Resell, sublicense, or commercially exploit the app without written permission.

7. Content you create

Custom missions, hero names, rewards, and other content you or your child add ("Your Content") belong to you. You grant us a limited license to store, display, and process Your Content solely to run the app for your family (e.g., syncing across devices, showing today's missions). We don't use Your Content to train advertising models and we don't sell it.

8. Our content & IP

The CapeQuest app, artwork, story text, mission packs, characters, logos, and code are owned by us or our licensors and are protected by copyright and trademark law. We grant you a personal, non-transferable, revocable license to use them inside the app for your family's own use.

9. Third-party services

CapeQuest runs on trusted providers including Supabase (auth, database, storage), PayMongo (payments), and email delivery services. Their handling of data is covered by their own terms. We don't control those services and aren't responsible for outages or actions on their platforms.

10. Not medical or clinical advice

CapeQuest is an educational and organizational tool. It is not a medical device, therapy, or diagnostic service, and it does not replace care from a licensed clinician (pediatrician, psychologist, therapist). If your child needs clinical support, please consult a qualified professional.

11. Service availability

We work hard to keep the app running, but we don't guarantee it will always be available, uninterrupted, or error-free. We may update, change, or discontinue features at any time. We'll give reasonable notice for material changes affecting paid plans.

12. Disclaimers

To the fullest extent permitted by law, CapeQuest is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific behavioral, academic, or emotional outcome.

13. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or related to the app is limited to the amount you paid us for the app in the 12 months before the claim (or PHP 2,000, whichever is greater). We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, data, or goodwill.

14. Termination

You can stop using CapeQuest and delete your account any time from Parent HQ → Settings, or by emailing hello@capequest.app. We may suspend or terminate accounts that violate these Terms, put children at risk, or abuse the service. If we terminate for cause, no refund is owed.

15. Changes to these Terms

We may update these Terms as the app evolves. If changes are material (e.g., new billing rules), we'll notify parents by email or in-app before they take effect. Continued use after the effective date means you accept the updated Terms.

16. Governing law & disputes

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of Metro Manila, Philippines. Nothing here limits any non-waivable consumer rights you have where you live.
